NHID issues guidance on Title 37, P/C signature requirements during COVID-19 pandemic
The New Hampshire Insurance Department issued Bulletin No. 20-021-AB to advise all property/casualty insurance producers and insurers in the state to take precautions when seeking Title 37 mandated signatures. The bulletin notes that electronic signatures meet the Title 37 signature requirements—meaning the signature requirements in New Hampshire’s Insurance Laws. The bulletin further advises that precautions taken during the COVID-19 pandemic should not prevent insurance producers or insurers from obtaining electronic signatures from their insureds.
If obtaining electronic signatures is not practical due to the insurer’s system, the bulletin allows the producer or insurer to process the transaction while noting the need to obtain a signature. The producer or insurers will need to obtain the signature when the COVID-19 emergency subsides.
The NHID will not take regulatory action against producers or insurers that do not obtain electronic signatures during the pandemic. However, the department expects normal procedures to resume when the COVID-19 emergency subsides.
